Γι' αυτό πήρε πίσω τους βαθμούς ο Άρης - Τον πληρώνει η ΕΠΟ - Δικαίωση από CAS και... Ουκρανία!

Αυτό είναι ολόκληρο το διατακτικό του Ευρωπαϊκού Δικαστηρίου, που αναλύει τι θα συμβεί από εδώ και πέρα στην υπόθεση

Το φως της δημοσιότητας είδε το διατακτικό του CAS για την υπόθεση της δικαίωσης της ΠΑΕ Άρης.

Είναι το… πολυπόθητο email προς τους νομικούς του Άρη, όπου ουσιαστικά το CAS αναφέρει πως εξέτασε και “εξαφανίζει” την τιμωρία που είχε επιβληθεί από τα ελληνικά δικαστήρια της εξυγίανσης.

Η πρόεδρος της επιτροπής που εξέτασε την υπόθεση ήταν από την Ουκρανία. Την πλευρά του Άρη εκπροσώπησαν οι Κωνσταντίνος Ζέμπερης, Χρυσούλα Σεβαστοπούλου ενώ η ΕΠΟ είχε στη διάθεση της Ελβετούς νομικούς!

Όπως αναφέρει το διατακτικό:

Το Διαιτητικό Αθλητικό Δικαστήριο αποφαίνεται ότι:

1. Η έφεση που άσκησε στις 21 Σεπτεμβρίου 2021 η ΠΑΕ Άρης κατά της υπ’ αριθ. 29/2021 που εκδόθηκε στις 31 Ιουλίου 2021 από την Επιτροπή Προσφυγών της Ε.Π.Ο.
2. Απόφαση αριθ. 29/2021 που εκδόθηκε στις 31 Ιουλίου 2021 από την Επιτροπή Προσφυγών της Ε.Π.Ο. ακυρώνεται στο μέτρο που αφορά τα πορίσματα σχετικά με τις κατηγορίες που ασκήθηκαν σε βάρος της ΠΑΕ Άρης και τις κυρώσεις που επιβλήθηκαν στην ΠΑΕ Άρης, δηλαδή πρόστιμο. 20.000 ευρώ (είκοσι χιλιάδες ευρώ) και ποινή αφαίρεσης 6 (έξι) βαθμών από την κατάταξη του εγχώριου πρωταθλήματος τη σεζόν 2021/22.
3. Η προσφυγή που άσκησε στις 21 Σεπτεμβρίου 2021 ο αείμνηστος κ. Θεόδωρος Καρυπίδης κατά της υπ’ αριθ. 29/2021 που εκδόθηκε στις 31 Ιουλίου 2021 από την Επιτροπή Προσφυγών της Ελληνικής Ποδοσφαιρικής Ομοσπονδίας είναι αμφισβητήσιμη και θα διαγραφεί από τη λίστα CAS.
4. Τα έξοδα της διαιτησίας, που θα καθοριστούν και θα επιδοθούν στα Μέρη από το Δικαστήριο του CAS, βαρύνουν εξ ολοκλήρου την Ελληνική Ποδοσφαιρική Ομοσπονδία.
5. Η Ελληνική Ποδοσφαιρική Ομοσπονδία και ο αείμνηστος κ. Θεόδωρος Καρυπίδης βαρύνουν τα δικά τους έξοδα και η Ελληνική Ποδοσφαιρική Ομοσπονδία θα καταβάλει συνεισφορά 5.000 CHF (πέντε χιλιάδες Ελβετικά Φράγκα) για τις δικαστικές αμοιβές του Ποδοσφαιρικού Ομίλου Άρη και τα λοιπά έξοδα που προκύπτουν σε σχέση με αυτή τη διαιτησία. διαδικασία”.

OPERATIVE PART

The Court of Arbitration for Sport rules that:

1. The appeal filed on 21 September 2021 by Aris Football Club against decision no. 29/2021 rendered on 31 July 2021 by the Appeals Committee of the Hellenic Football Federation is upheld.
2. Decision no. 29/2021 rendered on 31 July 2021 by the Appeals Committee of the Hellenic Football Federation is set aside insofar it concerns the findings regarding the charges brought against Aris Football Club and the sanctions imposed on Aris Football Club by the Hellenic Football Federation, namely a fine of EUR 20,000 (twenty thousand Euros) and a penalty of 6 (six) points deduction from its domestic league ranking in the 2021/22 season.
3. The appeal filed on 21 September 2021 by the late Mr Theodoros Karypidis against decision no. 29/2021 rendered on 31 July 2021 by the Appeals Committee of the Hellenic Football Federation is moot and shall be deleted from the CAS roll.
4. The costs of the arbitration, to be determined and served on the Parties by the CAS Court Office, shall be borne in their entirety by the Hellenic Football Federation.
5. The Hellenic Football Federation and the late Mr Theodoros Karypidis shall bear their own costs and the Hellenic Football Federation shall pay a contribution of CHF 5,000 (five thousand Swiss Francs) towards Aris Football Club’s legal fees and other expenses incurred in connection with these arbitration proceedings.
6. All other and further motions or prayers for relief are dismissed.
